Standard Working Hours

In the Philippines, the standard working hours are defined under the Labor Code. Employees are typically required to work:

  • 8 hours per day
  • 5 days per week (totaling 40 hours per week)

Employers may schedule these working hours differently, but they must not exceed the standard 40-hour workweek without incurring overtime obligations.

Meal and Rest Breaks

Employees are entitled to a meal break, commonly one hour, which is not counted as part of their working hours. However, shorter meal breaks of no less than 20 minutes can also be provided, which may be paid if employees are required to remain on-site or on-call during these breaks.

Additionally, brief rest periods (coffee or snack breaks) ranging from 5 to 20 minutes are considered compensable working hours, as they primarily benefit the employer by rejuvenating employees to maintain productivity.

Overtime Regulations

Overtime occurs when an employee works more than the standard 8-hour daily shift. According to the Philippine Labor Code, overtime compensation rates are as follows:

  • Regular days: Additional 25% of the hourly rate
  • Rest days or special holidays: Additional 30% of the hourly rate
  • Rest day coinciding with a special holiday: Additional 50% of the hourly rate
  • Regular holidays: Additional 30% of the hourly rate
  • Regular holiday coinciding with a rest day: Additional 30% of the hourly rate

Calculation Example

To calculate the overtime rate, take the hourly rate and multiply it by the applicable overtime percentage:

  • Example: An employee earning PHP 100 per hour working overtime on a regular day receives:
    • PHP 100 + (25% × PHP 100) = PHP 125 per overtime hour

Night Shift Differential

Employees working between 10:00 PM and 6:00 AM are entitled to a night shift differential, receiving at least 10% more than their regular hourly rate.

Limits and Restrictions

Employers are generally discouraged from requiring excessive overtime. The Department of Labor and Employment (DOLE) stipulates that mandatory overtime should only be required in exceptional circumstances such as emergencies, urgent work necessary to prevent serious losses, or when work is necessary to avoid disruption of business operations.

Record-Keeping Requirements

Employers must accurately maintain records of daily working hours and overtime to ensure compliance with labor regulations. These records should be made available for inspection by labor authorities upon request.
